    • Two, three or more years of probation
    • Community service

There is also NY Penal code 225.10 which constitutes the ruling for promoting gambling in the first degree. This i a heavier offence than promoting gambling in the second degree. A person is guilty of promoting gambling in the first degree when they knowingly advance or profit from unlawful gambling activities by:

  •  Engaging in bookmaking in total more than 5 bets, more than 5000 dollars
  • Receiving money or written records other than a player whose chances or plays are represented by such money or records
  • Receiving more than five hundred dollars in any one day of money played in such scheme or enterprise

Involvement in such activities is classed as a Class E non-violent misdemeanor and can grant you up to 4 years in state prison.
